Punishment is the imposition of adversity or suffering in reaction to misconductor wrongdoing ("The Legal Dictionary.com", 2014). According to Murphy the essential elements for punishment is that it is some sort of evil. It is also the imposition of something negative or the denial of goods. Additionally, it is the “failure to measure up to some binding standard.” Finally, the punishment must be handed down by someone in authority (Murphy, p.113, 2014). Additionally, according to Murphy Joel Feinberg states, punishment has afundamentally expressive purpose, whenever punishment is found it expresses judgments of condemnation and attitudes of anger and bitterness (Murphy, p. 115, 2014).
